Terms of Use

These Terms of Use (“Terms”) govern your access to and use of https://rollcam.com, the RollCam mobile application, and RollCam-installed tablet kiosks located in participating gyms (collectively, the “Service”), operated by RollCam LLC (“RollCam”, “we”, “us”, or “our”).





By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.




1. Description of Service




RollCam provides a self-service video recording platform located inside independently operated gyms. Users may record training sessions and receive a secure link to their recording via SMS.





RollCam acts solely as a technology provider. We do not own, operate, manage, or supervise participating gyms or their activities.




2. Eligibility




You must be at least 18 years old to use the Service independently. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian and in accordance with gym policies.




3. User Content




Users retain ownership of any video content they record using the Service.





By using the Service, you grant RollCam a limited, non-exclusive, royalty-free license to store, process, transmit, and deliver your video content solely for the purpose of operating and providing the Service.





You are responsible for ensuring that your use of the Service and any content recorded complies with applicable laws and gym policies.




4. Acceptable Use



You agree not to:


    

  • Use the Service for unlawful purposes;
    • 

  • Record content in violation of gym rules or without appropriate consent;
    • 

  • Attempt to interfere with, disrupt, or gain unauthorized access to the Service;
    • 

  • Upload or transmit malicious code, viruses, or harmful software;
    • 

  • Misuse payment systems or subscription features.
    • 




5. Video Storage and Availability




Videos are stored on secure cloud infrastructure. While we use commercially reasonable efforts to maintain availability, RollCam does not guarantee that video recordings will be available at all times or permanently.





Users are responsible for downloading and retaining their recordings after delivery. RollCam may delete recordings in accordance with current or future retention policies.




6. Subscriptions and Hardware Deposits




Certain gyms may enter into subscription agreements with RollCam. Subscription fees and hardware deposits are subject to separate written agreements between RollCam and the gym operator.





Hardware deposits are refundable subject to return of equipment in good working condition, normal wear and tear excepted.




7. Payments




Payments are processed through third-party payment providers such as Stripe. RollCam does not store or process credit card information directly.




8. Third-Party Services




The Service relies on third-party providers, including cloud hosting services and SMS delivery providers. RollCam is not responsible for outages, delays, or failures caused by third-party systems.




9. Disclaimer of Warranties




The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.





We do not warrant that the Service will be uninterrupted, secure, or error-free.




10. Limitation of Liability




To the fullest extent permitted by law, RollCam LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.





In no event shall RollCam’s total liability exceed the amount paid, if any, by you for use of the Service during the twelve (12) months preceding the claim.




11. Indemnification




You agree to defend, indemnify, and hold harmless RollCam LLC and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service, your recorded content, or your violation of these Terms.




12. Intellectual Property




All intellectual property related to the Service, including software, branding, logos, and design, is owned by RollCam LLC. You may not copy, modify, distribute, or reproduce any portion of the Service without written permission.




13. Termination




We reserve the right to suspend or terminate access to the Service at our discretion if these Terms are violated or if misuse is suspected.




14. Governing Law




These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.




15. Changes to Terms




We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
